The legal and regulatory environment of business is one of the most important subjects you’ll be asked about as a new contractor. The fact is that no one wants to be found out, and the fact is that a lot of people don’t know what they’re doing. This is why it’s so important to keep your project on the straight and narrow path.
The reality is that most construction companies have no idea what the legal and regulatory environment is like. It can be really complicated. Even if you hire the right person, you might not know how to properly navigate all the laws and regulations that apply to your project. For example, a good contractor’s job is to not even know that the building inspector is coming and going and making sure things are up to code.
Not to mention, some of the laws that you might be required to comply with are completely out of your control. For example, it could be a requirement that you have a construction license. There are even laws that you might not know exist. If you don’t want to follow them, there are still a myriad of ways you can legally bypass them. For example, you could hire someone to show you how to do a specific procedure, but you have no idea how to do it yourself.
This is a good point. There was a case last year where a man was fined $1,000 for allegedly using a piece of equipment to create a video of his wife and children trying to get in his pants. Apparently the equipment he used was a blackjack. The woman who was allegedly paying for the video claimed the footage was not her, but her husband took that as a sign that the video was his.
Another case of hiring someone to show you how to do something but you don’t know how to do it yourself. In this instance, the woman was claiming the footage was the husband’s, so the man was fined.
I was reading a case once where a woman was suing for the loss of sexual pleasure after having sex with her boyfriend (the man who actually did the video). I said to her, “so who was paying for this video?” She said, “I believe it was my husband but I’m not sure.” My response was, “if you’re claiming that the video was yours, then you’re in the wrong, because you’re making it up.
There are several different ways that a company can be held responsible for actions of employees. First of all, its your job to make sure that the employees you hire are following the company’s policies. If you hire a person with a bad personality and then later find out that they have a bad personality, then you owe the company a lot.
It is also the job of your lawyers and tax accountants to figure out what your company should and should not do. If that company is in a position to make you aware of actions of its employees, that would be your job. If they are not in a position to do that, then they shouldn’t be doing it.
If you haven’t already, go to your local library. You’ll find several books devoted to the subject. It’s a good idea to become familiar with the basics of the legal and regulatory environment in the U.S. Before you go further, however, you should know that the legal and regulatory environment of business (in the U.S. at least) can be very confusing and often, it can be very dangerous.
It is always a good idea to know what you are signing on the dotted line. Before you sign a contract for a business relationship, you should consider the various risks that you might run and the potential for significant injury or even death should you not take precautions.
